Nursing Homes Support Scheme (Amendment) Bill 2021 signed into law

The Nursing Homes Support Scheme, commonly known as Fair Deal, has been amended under new legislation which aims to enhance protections for family farms and businesses, and remove any disincentive for those who wish to sell their vacant home while in the Scheme.

The changes introduced by the Nursing Homes Support Scheme (Amendment) Act 2021 will mean that after a period of 3 years, the value of a family-owned farm or business will no longer be taken into account when calculating the cost of a person’s nursing home care, where a family successor commits to working the farm or business.

Furthermore, the existing 3-year cap on contributions based on the value of a person’s principal residence will be extended to the proceeds from the sale of that residence.

The Act also introduces a right for any person attending an interview under the Scheme to be accompanied by another person over 18 years of age.

The new measures will come into operation on Wednesday, 20 October 2021.

Further legislative changes have been proposed regarding the exemption of rental income earned on a property where an individual has moved into nursing home care.
